CMP No.26423 of 2023 in CMA SR No.143927 of 2023 N.ANAND VENKATESH,J Notice has been served on the respondent and he is represented through a counsel.

2. This civil miscellaneous petition has been filed seeking to condone the delay of 339 days in filing the main civil miscellaneous appeal.

3. Heard the learned counsel for the petitioners and the learned counsel for the respondent and perused the records.

4. Having satisfied with the reasons assigned in the affidavit filed in support of this petition, the civil miscellaneous petition is allowed and the delay of 339 days is condoned.

5. It is made clear that for the period of delay of 339 days, the petitioners/appellants will not be entitled for any interest in the event of this Court enhancing the amount of compensation fixed by the Tribunal below.

6. Registry is directed to number the main civil miscellaneous appeal and list the same for admission. When the matter is posted for admission, the name of learned counsel for respondent shall also be printed in the cause-list.
