O R D E R

The petitioner has filed this writ petition seeking issuance of Writ of Certiorari calling for the records of the first respondent made in his proceedings in Na.Ka.No.A5/1798/2019, dated 08.02.2022 and to quash the same.

2.The learned counsel appearing for the petitioner submitted that the petitioner is the son of the fourth respondent. The fourth respondent made application before the first respondent under the Maintenance and Welfare of Parents and Senior Citizens Act and the first respondent passed the impugned order directing the petitioner to maintain the fourth respondent. The learned counsel further submitted that the property was purchased by the fourth respondent, however, the construction of superstructure was put up out of the fund provided by the petitioner and without considering the same, the first respondent directed the petitioner to grant residential status to the fourth respondent and to maintain the fourth respondent, which is not sustainable one.

3.The learned counsel appearing for the fourth respondent submitted that already the fourth respondent filed W.P.No.5698 of 2023 for implementation of the order passed by the first respondent dated 08.02.2022 and this Court vide order dated 21.10.2024 directed the fourth respondent to lodge a complaint before the third respondent and issued direction to the third respondent to implement the order passed by the first respondent. The learned counsel further submitted that once the order passed by the first respondent dated 08.02.2022 was upheld by this Court in W.P.No.5698 of 2023, challenging the very same order again in this writ petition is not sustainable one. 4.Heard both sides and perused the materials available on record.

5.Perusal of records disclose that already the fourth respondent filed W.P.No.5698 of 2023 for implementation of the order passed by the first respondent dated 08.02.2022 and this Court vide order dated 21.10.2024 directed the fourth respondent to lodge a complaint before the third respondent and issued direction to the third respondent to implement the order passed by the first respondent. 3/5

Once the order passed by the first respondent dated 08.02.2022 was upheld by this Court in W.P.No.5698 of 2023, challenging the very same order again in this writ petition is not sustainable one. 6.The writ petition is dismissed. No costs. Consequently, the connected miscellaneous petition is closed.
