Respondent PRAYER: Civil Revision Petition is filed under Article 227 of the Constitution of India, to set aside the order dated 18.09.2024 made in I.A.No.1 of 2023 in O.P.No.3771 of 2022 on the file of the IV Additional Family Court at Chennai and to direct the learned IV Additional Judge, Family Court at Chennai to decide the I.A.No.1 of 2023 on merits separately within the time frame fixed by this Court. 1/4

O R D E R

The civil revision petition seeks for expeditious disposal of I.A.No.1 of 2023 in O.P.No.3771 of 2022 on the file of the IV Additional Family Court at Chennai.

2. When the matter came up for admission on 18.11.2024, I called for a report from the learned Trial Judge to state as to how long she requires to dispose of the main O.P.No.3771 of 2022 itself.

3. The learned IV Additional Principal Judge, Family Court at Chennai has submitted a report stating that O.P.No.3771 of 2022 is filed by the petitioner/husband for divorce on the ground of cruelty. I.A.No.1 of 2023 is filed by the husband for return of articles. The said I.A. was ordered to be tried along with the main O.P. Meanwhile, the respondent/wife filed I.A.No.4 of 2024 for return of her money, I.A.No.5 of 2024 for receiving additional documents & I.A.No.6 of 2024 for return of articles. The report further states that all the above interlocutory applications are pending enquiry. Therefore, he requires 20 days to dispose of all the I.As. and three months time to dispose of the main O.P. 2/4

Taking into consideration the report of the learned Trial Judge, there shall be a direction to the learned IV Additional Principal Judge, Family Court at Chennai, to dispose of all the interlocutory applications pending on its file by 21.12.2024 and to dispose of O.P.No.3771 of 2022 within a period of four months from the date of receipt of a copy of this order.
