ORDER

This petition has been filed to relax the condition imposed on the petitioner in Crl.M.P.No.9976 of 2025 in Crl.A.No.469 of 2025 dated 08.05.2025 that the petitioner shall appear before the trial Court on the first working day of every month at 10.30 a.m., till the disposal of the appeal. 2.The learned counsel for the petitioner submitted that the petitioner was convicted by the trial Court in Spl.C.C.No.9 of 20214, against which, he preferred an appeal before this Court along with suspension of sentence petition in Crl.M.P.No.9976 of 2025. This Court, by the order dated 08.05.2025, suspended the sentence of the petitioner on condition that the petitioner to 2/4

appear before the trial Court on the first working day of every month at 10.30 a.m., till the disposal of the appeal. He further submitted that the petitioner is aged about 75 years, suffering with nervous problem and taking treatment and he cannot move without aid of others. Hence, he finds it difficult to comply with the conditions. He further submitted that the petitioner has got deep social root, residing with his family and he will not evade justice and will prosecute the appeal with diligence.

3.The learned Additional Public Prosecutor appearing for the respondent police submitted that the petitioner is complying with the conditions imposed by this Court for the past four months diligently. The petitioner's health ailments is not seriously disputed.

4.Considering the submission made by the learned Additional Public Prosecutor that the petitioner has been complying with the conditions diligently, the condition imposed on the petitioner to appear before the trial Court on the first working day of every month at 10.30 a.m., till the disposal of the appeal, is totally relaxed.
