This petition has been filed seeking restoration of the appeal, which was dismissed for non-prosecution on 07.12.2022. This petition has been filed within five days of the said dismissal i.e., on 12.12.2022. 2.The reason assigned in the petition for restoration is the personal inconvenience of the counsel, who was entrusted with the matter. We are therefore, of the opinion that opportunity should be given to the appellant to prosecute the appeal. Hence, this petition is ordered, the appeal in A.S.No.491 of 2016 is restored to file.

3.Registry is directed to list the appeal for final hearing on 18.10.2023.
