This Criminal Original Petition has been filed to call for the records in Spl.S.C.No.59 of 2021 on the file of the Special Court for the Exclusive Trial of POCSO Act Cases, Salem and quash the same.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the first respondent/police and perused the materials available on record.

3. A case in Spl.S.C.No.59 of 2021 was registered as against the petitioner under POCSO Act and the trial has been commenced by the Special Court for the Exclusive Trial of POCSO Act Cases, Salem. Prosecution witnesses have been examined. On a perusal of the statement recorded under Section 161 Cr.P.C., it is found that there are prima facie materials available as against the petitioner. The defence taken by the petitioner can be decided only during trial. Hence, this Court is not inclined to allow this petition. However, the petitioner is at liberty to

take all his defence before the trial court.
