Respondent PRAYER: Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus directing the respondent to consider my representation dated 11.06.2024 submitted for payment of arrears of back wages and all other terminal benefits calculated by taking into account of my deemed service from the date of the petitioner's suspension ie., January - 2007 including annual increments, wage revision, notional promotion and EPS pension scheme.

ORDER

The Writ Petition has been filed in the nature of a Mandamus seeking to consider the representation of the petitioner who had sought payment of arrears of backwages and other terminal benefits. The petitioner claims that his period of service must be calculated from his suspension, namely, January 2007.

2. In the affidavit filed in support of the Writ Petition, it had been stated that the petitioner had joined the service of the respondent bank on 19.02.1986 as jewel appraiser. He was placed under suspension on 27.01.2007 owing to various irregularities alleged. He was then dismissed from service on 08.04.2009 after enquiry had been conducted. He then filed an appeal and the order of dismissal was set aside. The respondent filed a further appeal and also filed Writ Petition which was dismissed. The Writ Appeal was also filed by the respondent. It had been stated that the Writ Appeal was again dismissed. The petitioner stated that he was ready to join back in duty. The respondent filed a further appeal before the Supreme Court. That was also dismissed. The respondent then filed Review Application before the Supreme Court which was also dismissed. The

petitioner now has given a representation seeking payment of backwages and all other terminal benefits.

3. The respondent may examine the representation given, examine the service records of the petitioner and also examine the purport of the orders passed and thereafter take necessary steps to dispose of the representation within a period of three months from the date of receipt of a copy of this order.
