This application has been filed to dispense with the issuance of notice under Section 80 CPC to the third defendant in the above suit.

2. The learned counsel for the applicant would submit the applicant is seeking relief only against the defendants 1 and 2 and the third defendant is only a formal party. It is further stated that he had already issued notice to the third defendant and in view of the urgency, this application has been filed.

3. In view of the above submissions, this application is ordered.
