Prayer : Writ Petition (Criminal) filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the respondents police herein to provide adequate police protection to the petitioner for removing the movable articles vested in the petitioner's property upon petitioner representation dated 04.08.2025 and to dispose the same by the respondent police.

ORDER

This Writ Petition (Criminal) has been filed seeking a direction to the first respondent to provide adequate police protection to the petitioners to enable them to remove the movable articles located within their property. 2.

Heard the learned counsel appearing on either side and perused the materials available on record.

The petitioners are the owners of the property comprised in S.Nos.88/1, 88/1A, New S.No.88/86, admeasuring 2000 sq.ft, situated at No.3, 2nd Floor, Church Street, Redhills, Naravarikuppam, Chennai. The property was leased out to one N.Sumathi for a period of 15 years at a monthly rent of Rs.60,000/- to run a scan center in the name and style of "Golden Scan Centre".

Subsequently, the tenant, N.Sumathi committed suicide along with her family due to financial distress. The incident occurred within the jurisdiction of Thirumangalam Police Station, which registered an FIR in Crime No.109 of 2025 under Section 194 of Bharatiya Nagarik Suraksha Sanhita, 2023. Thereafter, the premises, which was rented out to the said N.Sumathi, remained under the lock and key of the respondents 2 and 3 herein. There are movable articles are available in the rented premises. Further, admittedly, the rental agreement entered into between the petitioners and the deceased has come to an end and there is no relationship of landlord and tenant. 4.

In view of the above, the second and third respondents, being the legal heirs of the deceased N.Sumathi, are directed to take all the movable articles, which is available in the petitioners' premises by opening the lock and to hand over the vacant possession of the subject property to the petitioner within a period of two weeks from the date of receipt of a copy of this order. 5.

With the above direction, this Writ Petition (Criminal) stands disposed of. No costs.
