ORDER

Dr. S. Suriya, learned Additional Government Pleader takes notice for the 1st respondent and Mr.J.C. Durairaj, learned Additional Government Pleader takes notice for the 2nd respondent. By consent of both the parties, this writ petition is taken up for final disposal at the admission stage itself.

2. This writ petition has been filed to quash the proceedings of the 1st respondent made in Na.Ka.No.3520/2020 Sa.Pa., dated 02.09.2021.

3. The petitioner was appointed as an Assistant in the 2nd respondent Society on 01.10.1993, and was subsequently promoted. Thereafter, he was deputed as Secretary (in-charge) at the Adi Dravidar and Tribal Welfare Cooperative Society, Kallakurichi, and later re-posted to the 2nd respondent Society, where he continues to serve as Assistant.

4. During the year 2019, the 2nd respondent Society issued a charge memo dated 26.08.2019, to which the petitioner submitted his explanation. Subsequently, the 2nd respondent imposed a punishment of stoppage of five annual increments with cumulative effect by order dated 11.02.2020. Aggrieved by the said punishment, the petitioner preferred a revision petition under Section 153 of the Tamil Nadu Co-operative Societies Act, 1983 before the 1st respondent, denying the charges framed against him. However, the 1st 2/5

respondent, by order dated 02.09.2021, rejected the said revision petition, which is impugned herein.

5. The petitioner further submits that he has filed a review petition under Section 154 of the Act against the aforesaid order, but the same has not been taken into consideration till date.

Learned counsel for the petitioner would submit that the petitioner restricts the relief sought for in this writ petition, and it would suffice if a direction is issued to the 1st respondent to consider and dispose of the petitioner's review petition, within a time frame to be fixed by this Court.

7. Dr. S. Suriya, learned Additional Government Pleader appearing for the 1st respondent, would fairly submit that as against the revision order, the petitioner has an effective alternative remedy of review. She further submits that, in the event the petitioner is permitted to produce proof of filing of the review petition, the same will be considered by the 1st respondent in accordance with law.

Considering the fair submission made by the learned Additional Government Pleader appearing for the 1st respondent, this Court, without expressing any opinion on the merits of the case, directs the petitioner to submit proof of having filed the review petition before the 1st respondent within a 3/5

period of two weeks from the date of receipt of a copy of this order. On such production, the 1st respondent shall consider and dispose of the petitioner's review petition on its own merits and in accordance with law, within a period of eight weeks.

9. With the aforesaid directions, this writ petition stands disposed of. No costs.
