Prayer: Petition is filed under Article 226 of the Constitution of India, seeking Writ of Mandamus, directing the respondents to consider the representation of the petitioner to the post of Gangman (Trainee) within a reasonable time frame after affording the petitioner a personal hearing.

ORDER

The Writ Petition is filed for the relief of a Mandamus, directing the respondents to consider the representation of the petitioner to the post of Gangman (Trainee) within a reasonable time frame after affording the petitioner a personal hearing.

2. The petitioner would submit that he belongs to the Most Backward Community (MBC) and is fully eligible to be appointed to the post of Gangman (Trainee) pursuant to the recruitment notification. The petitioner has successfully cleared the written examination and physical test. The petitioner would submit that the candidates belonging to the MBC category who have secured less marks than the petitioner have been recruited for the said post. Thus aggrieved, the petitioner has made several representations to the respondents seeking appointment to the said post. Since there is no response, the petitioner is before this Court.

3. The learned Standing Counsel appearing for the respondents would submit that the claim of the petitioner is barred by limitation and prayed for the writ petition to be dismissed.

4. Heard the learned counsels on the either side and perused the records.

5. The submission of the learned standing counsel that the claim of the petitioner is barred by limitation cannot be accepted, since the duty is cast upon the respondents to give a reply to the representations of the petitioner, in accordance with law. They cannot keep quite and sit over without replying to the representations of the petitioner.

6. In view of the above, a direction is issued to the 2nd respondent to consider the representation of the petitioner, in accordance with law and pass orders, within a period of 6 weeks from the date of receipt of a copy of this order.

7.The Writ Petition is disposed off with the above direction. No costs.
