C O M M O N O R D E R These writ petitions have been filed to issue a Writ of Certiorarified Mandamus to call for the records in respect of the Final Notice (Ref Rs.76,747/-, Rs.80,927/- and Rs.81,117/- towards Rent and GST arrears for Shop No 8-N103-071-G4/1, Shop No 8-N103-071-G4/1 and Shop No 8-N103071-G4/2 and 8-N103-071-G4/3 respectively issued by the respondent and to quash the same and forbear the respondent or respondent authorities from taking any coercive action of locking, sealing or evicting the petitioner from the said shops.
2. The Law Officer of Greater Chennai Corporation had come over to the Court consequent to an earlier direction and he had stated that till 2015 the rents for the shops were paid to the Greater Chennai Corporation without any default and thereafter, the rents have not been paid. The rents have been revised from the financial year 2016-1017. The petitioner has not paid the revised rent also. Shops have also been closed and they have remained closed for more than four years as on date.
3. Accordingly, these writ petitions stands dismissed giving liberty to the respondent to break open the shops after putting up necessary notice in the frontage of the shops and thereafter lease it out to fresh lessees in the manner known to law and to take any decision as it would be appropriate for the Corporation for augment income in the manner known to law. No costs.
