ORDER
The petitioner, who was arrested and remanded to judicial custody on 25.07.2025 for the alleged offence punishable under Section 316 (2) and 318(4) of BNS 2023 in Crime No. 368 of 2024 on the file of the respondent police, seeks bail.
2.This Court earlier considered the petition on the basis of the submission made by the learned Counsel for the petitioner and granted interim bail with a condition to deposit a sum of Rs.12,00,000/- to the credit of Crime No. 368/2024 within a period of twelve weeks from the date of order i.e., 12.09.2025. However, as on today, three months time is over but the petitioner has not come forward to deposit the said amount as directed by this Court on 12.09.2025. Hence, this Court is of the view that the petitioner shall surrender and seek bail.

When the matter was listed again on 17.12.2025, this Court is directed the petitioner to surrender before the concerned before the Court since the petitioner has failed to deposit a sum of Rs.12,00,000/- to the credit of Crime No. 368 of 2024, within a period of twelve weeks from the date of that order as 2/5
accepted by the petitioner. In the meanwhile, this petitioner has filed Crl.M.P.No.23612 of 2025 seeking for modification and the same was dismissed by this Court on 17.12.2025 directing the petitioner to surrender before the concerned Court on 02.01.2026.
4.Today, the case was listed before this Court i.e., on 05.01.2026, the petitioner has not surrendered before the concerned Court as ordered by this Court by order dated 17.12.2025.
5.The learned Counsel for the petitioner submits that the petitioner has filed an application before the Registry seeking extension of time and it is yet to be numbered.
6.Considering the above facts, and this Court having taken the view vide order dated 12.09.2025 that the petitioner has been involved in cheating the defacto complainant to the extent of Rs.40,00,000/-, in spite of the interim relief granted to the petitioner, the same has not been utilized by the petitioner herein. Further, considering the merits and the allegations, the petitioner is not entitled to bail. Consequently, the interim bail earlier granted by this Court stands cancelled. The respondent police is directed to take steps to detain the accused. 3/5
