ORDER
These petitions have been filed seeking cancellation of anticipatory bail on the ground that the petitioner has not complied the conditions.
2. The learned counsel appearing for the respondents/bail petitioners submitted that, already the respondents/bail petitioners have approached the Apex Court seeking modification of the conditions imposed by this Court which directs the bail petitioners to deposit the money within a period of two weeks and the Apex Court also granted interim stay in this regard.
3. The learned counsel for the defacto complainant filed separate criminal miscellaneous petition and impleaded himself, submitted that this Court has granted 15 days to surrender
before the learned Judicial Magistrate No.I, Poonamallee, which got lapsed and hence the order become infructuous.
4. Admittedly, this Court has granted anticipatory bail to the petitioner to deposit Rs.10 lakhs and the same has been challenged before the Apex Court and the Apex Court also granted interim stay. At this stage, canceling the anticipatory bail does not arise.
5. Accordingly, these criminal miscellaneous petitions are closed. Based on the outcome of the SLP, the prosecution as well as the defacto complainant is directed to initiate fresh proceedings.
