Aggrieved by the dismissal of the petitioner's complaint filed under Section 138 of the Negotiable Instruments Act, 1881 for non-prosecution, the petitioner/complainant has filed the present petition seeking leave to file an appeal.

2.The learned counsel for the petitioner would submit that the petitioner's absence was neither willful nor wanton; and that though the petitioner had filed a petition under Section 256 Cr.P.C., the same was dismissed and one more opportunity may be given to the petitioner to establish the case on merits.
