The petitioner/A1 apprehends arrest by the respondent police in respect of the Non-Bailable warrant issued by the Additional Chief Metropolitan Magistrate Court, Egmore, Chennai, in C.C. No.2701 of 2024 in Crime No.RC 032 2022 A0005 of 2022 for the alleged offences under Section 120(B) r/w 420, 468 and 471 of IPC, seeks anticipatory bail. 2.

When the matter is taken up for hearing today, the learned counsel appearing for the petitioner would submit that the petitioner is arrayed as A1 in this case and due to his non-appearance, the Trial Court has issued non-bailable warrant and the same is pending before the Trial Court and the petitioner is ready to surrender and hence he seeks anticipatory bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent police submits that the Trial Court has issued nonbailable warrant against the petitioner for his non-appearance and the same is pending in C.C.No.2701 of 2024.

Considering the representations on both sides and considering that NBW is pending against the petitioner, it is appropriate to direct the petitioner to appear before the Trial Court where NBW is pending by filing an appropriate petition to cancel the non-bailable warrant. Accordingly, the petitioner is directed to appear before the Trial Court by filing appropriate application to cancel NBW issued against him and if any such application is filed, the Trial Court is directed to consider the said application on the same day on merits in accordance with law.

With the above directions, this criminal original petition is disposed of. Time to surrender before the Trial Court is extended for a period of 15 days.
