This petition has been filed to modify the condition to furnish cash deposit of a sum of Rs.10,000/- instead of the petitioner depositing the original title deeds of an immovable property not less that the value of Rs.10 lakhs (stands in the name of petitioner or his relative or his friends) to the credit of Spl.C.C.No.84 of 2022 in the order passed in Crl.O.P.No.28457 of 2022 on the file of this Court.
2.The learned counsel for the petitioner would submit that the petitioner was granted bail in Crl.O.P.No.28457 of 2022 with a condition to deposit the original title deeds of an immovable property not less than the value of Rs.10 lakhs (stands in the name of the petitioner or his relatives or his friends), to the credit of Spl.C.C.No.84 of 2022, without prejudice to his rights and contentions before the trial Court. However, now the petitioner has filed the present petition to modify the above condition imposed in Crl.O.P.No.28457 of 2022. He would also submit that the petitioner is a poor agricultural coolie and he does not have any property to comply with the above condition. sp 3.Considering the above submissions, the condition imposed as against the petitioner is modified and the petitioner is directed to deposit a sum of Rs.20,000/- (Rupees Twenty Thousand only) to the credit of Spl.C.C.No.84 of 2022, without prejudice to his rights and contentions before the trial Court, within a period of two weeks from the date of receipt of a copy of this order, and on such deposit, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty five thousand only with two sureties (out of which, one surety should be a blood related surety, each for a like sum to the satisfaction of the learned Special Judge for EC/NDPS Act Cases, Salem.
