The petitioners, who were arrested and remanded to judicial custody on 20.05.2025, for the offence punishable under Sections 8(c), 1/4

20(b)(ii)(C), 25, 29(1), 27(A) of NDPS Act in Crime No.116 of 2025, registered on the file of the respondent, seeks bail.

2. The allegation against the petitioners is that the petitioners along with other accused were found in possession of 74 kilos of ganja. Hence, the case.

3. The learned counsel appearing for the petitioners submitted that the petitioners are innocent persons and they have been falsely implicated in this case. Hence, he prays to grant bail to the petitioners.

4. Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the contraband seized is a commercial quantity. Hence, he strongly opposed the grant of bail to the petitioners.

Considering the quantity of the contraband seized from the petitioner is a commercial quantity and rigours of Section 37 of NDPS Act is applicable to this case and no grounds were made out for satisfying twin conditions of Section 37 of NDPS Act, this Court is not inclined to grant bail to the petitioners with certain conditions:
