Crl.M.P.No.19382 of 2022 in H.C.P.No.2220 of 2022 M.SUNDAR, J and M.NIRMAL KUMAR, J (Order of the Court was made by M.SUNDAR.J.,) Read this in conjunction with and in continuation of earlier proceedings made in the previous listing on 06.02.2023, which reads as follows:

'Mr.S.Senthilvel, learned counsel representing Mr.P.Anbazhagan, counsel on record for petitioner is before us.

2. Captioned Criminal Miscellaneous Petition has been filed with a fix an early date prayer.

3. Mr.R.Muniyapparaj, learned State Additional Public Prosecutor accepts notice for all the five respondents. Learned Additional Public Prosecutor shall direct the jail authorities to take the detenu to medical officers in the jail and depending on the medical officer's opinion, take him to a Specialist, if necessary and place a report before us.

List one week hence. List on 13.02.2023.'

2. Mr.S.Senthilvel, learned counsel representing Mr.P.Anbazhagan, counsel on record for petitioner and Mr.R.Muniyappraj, learned Additional Public Prosecutor for respondents are before us.

3. Earlier proceedings dated 06.02.2023 is telltale qua the facts of the case and the trajectory the matter has taken.

4. Pursuant to aforementioned earlier proceedings, today learned Additional Public Prosecutor has placed before us a communication from the Jail Superintendent together with the medical report of the Civil Assistant Surgeon in the Central Prison Hospital, Puzhal, a scanned reproduction of which is as follows:

5. A careful perusal of the medical report leaves us with the considered view that there is nothing really so alarming that prayer in the captioned criminal miscellaneous petition has to be answered in the affirmative. However, we make it clear that it is open to the petitioner to come with a similar/same prayer if there is any other / further developments.

With the above observation, captioned Criminal Miscellaneous Petition disposed of as closed.
