Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Mandamus, directing the respondents to pay 10% interest for the belated payment of terminal benefits such as Gratuity, P.F. Leave Salary and Commutation of Pension amount, difference in Leave Salary and Gratuity based on 14th wage settlement dated 24.08.2022 and difference in Leave Salary and Gratuity based on 4% D.A. Increase with 10% interest to them.

ORDER

This Writ Petition has been filed seeking a direction to the directing the respondents to pay 10% interest for the belated payment of terminal benefits such as Gratuity, P.F. Leave Salary and Commutation of Pension amount, difference in Leave Salary and Gratuity based on 14th wage settlement dated 24.08.2022 and difference in Leave Salary and Gratuity based on 4% D.A. Increase with 10% interest to them.

2. Ms.S.Pavithra, learned Standing Counsel takes notice for the Respondents.

3. By consent, this Writ Petition is taken up for final disposal today at the admission stage itself.

4.The case of the petitioners is that the petitioners who were

working as Checking Inspectors in the 1st respondent Corporation, retired from service on various dates. The petitioners seek payment of the difference in gratuity, leave salary, Commutation of pension based on the wage settlement dated 24.08.2022 with 10% interest. Despite making detailed representation, the same has not been granted so far and hence the present writ petition is filed.

5. The learned Standing Counsel for the respondents would fairly submit that they are ready to settle the benefits as claimed by the petitioners, if they are eligible within a time frame to be fixed by this Court.

6. In view of the above submission of the learned Standing Counsels, without going into the merits of the case, this Court deems it appropriate to direct the respondents to consider the representation made by the petitioners herein on various dates viz., 30.12.2024, 17.03.2025, 19.03.2025, 21.03.2025, 24.03.2025, 26.03.2025, 02.04.2025 and 04.04.2025 respectively, on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.
