..Respondent Prayer : CMP is filed to clarify the High Court order dated 05-09-2024 passed in Tr. CMP. No.91 of 2024, the case OS.No.47 of 2023 is on the file of the learned District Munsif, Tambaram to be clubbed along with SMOP.No.219 of 2022 which is presently on the file of the learned Subordinate Judge, Tambaram.

Heard Mr.C.Saifullah. There is no representation for the respondent.

2. This is a petition for clarification. The clarification sought for is very limited.

3. Two proceedings had been initiated between the parties; SMOP.No.219 of 2022 on the file of the Family Court at Chengalpattu and O.S.No.47 of 2023 on the file of the District Munsif Court at Tambaram. While recording the facts in the order, instead of recording O.S.No.47 of 2023 is pending on the file of the District Munsif Court, it has been shown as if pending on the file of the Subordinate Court at Tambaram. This is obviously an error. Hence, paragraph 7 of the order dated 05.09.2024 in Tr.CMP.No.91 of 2024 shall read as follows:

"7. Taking overall circumstances into consideration, including the physical difficulties that may be expressed by the respective parties, I am inclined to withdraw SMOP.No.219 of 2022 on the file of the Family Court at Chengalpattu and transfer the same to the file of the Subordinate Court at Tambaram. Similarly, O.S.No.47 of 2023 pending on the file of the District Munsif Court at

Tambaram is withdrawn and transfer to the file of the Subordinate Court at Tambaram. The learned Subordinate Judge, Tambaram is requested to club SMOP.No.219 of 2022 along with O.S.No.47 of 2023 and dispose of the same by a common judgment."
