The petitioners / A1 and A2, who were arrested and remanded to judicial custody on 08.08.2023 for the offences punishable under Sections 8(c), 20(b)(ii)(C) of NDPS Act in Crime No.536 of 2023, seek bail.

2.It is stated on behalf of the respondent that the petitioners were found in possession of 20.200 Kg of Ganja each 10.100 Kgs. The total quantity of Ganja involved is commercial in nature. Both the petitioners had been arrested on the same day and found in possession of Ganja at the same time, which indicates that they were conscious of the possession of Ganja of the other person.

3.In view of that particular fact, since the stipulations under Section 37(2) of NDPS Act, will have to be examined, I am not inclined to grant bail to these petitioners. Accordingly, this Criminal Original Petition stands dismissed.
