The petition in CMP.Nos.25751 of 2023 is filed to bring on record the legal representatives of the deceased first appellant. The second petitioner herein is one of the legal representatives of the deceased first appellant and the second petitioner herein is already on record as the second appellant. Therefore, there is no abatement of the Second Appeal. Hence, the Civil Miscellaneous Petitions in CMP.Nos.25748 & 25749 of 2023 filed to set aside the abatement and to condone the delay in filing a petition to set aside the abatement are unnecessary and hence, they are dismissed. Therefore, CMP.No.25751 of 2023 is allowed and the petitioners 3 to 6 are brought on record and ranked as appellants 3 to 6.
