O R D E R

This Criminal Original Petition has been filed to direct the first respondent Superintendent of Police to transfer the investigation of petitioner's complaint dated 27.10.2022 to some other police officer.

2. The learned counsel for the petitioner submitted that the petitioner's sister-in-law borrowed a sum of Rs.5,00,000/- from one Srinivasan. The petitioner had repaid the amount with huge interest. However, the said Srinivasan had not returned the loan documents. In this regard, the petitioner gave a complaint before the respondents on 27.10.2022. However, no effective steps have been taken by them. Hence, the present petition has been filed.

3. The learned Government Advocate (crl.side) for the respondents submitted that one Srinivasan gave a complaint against the petitioner on 26.11.2022 alleging that he lent some amount to the petitioner and the petitioner 2/4

has not repaid the amount and cheated him. In respect of the complaint given by the said Srinivasan, enquiry has been conducted and the same is pending for the continuation of enquiry , since the petitioner has not cooperated for enquiry.

3. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.side) for the respondents.

4. Considering the submission made by the learned Government Advocate (crl.side) that enquiry is pending, this court is of the view that it is not necessary to transfer the investigation. Further, this Court directs the respondents to conduct proper investigation in this case and file the final report before the concerned Court in the manner known to law. This Court also directs the petitioner to appear before the investigating officer for enquiry.

5. With the above direction, this Criminal Original Petition stands disposed of.
