Respondent Prayer : The Transfer Civil Miscellaneous Petition is filed under Section 24 of the Code of Civil Procedure, to withdraw the proceeding in H.M.O.P.No.138 of 2020 on the file of the Sub Court at Arakkonam and transfer the same to the file of the Family Court at Thiruvallur to be tried along with M.C.No.31 of 2023 on the file of the Family Court at Thiruvallur.

ORDER

This Transfer Civil Miscellaneous Petition has been filed seeking transfer of proceeding from the file of the Sub Court at Arokonam in H.M.O.P.No.138 of 2020 to the file of the Family Court at Thiruvallur.

2. The distance between Arokonam and Thiruvallur is hardly about 50 Kms. It is not such a distance where the wife will be put to inconvenience, in case, she travels.

3. M/s.T.Gnana Banu, appearing for the wife, would submit that the wife is facing a threat from the respondent. If that is the situation, she may take recourse by bringing it to the notice of the learned Judicial Officer, who I am sure that if the threat is a real one, she will give an appropriate order in this regard.

4. However, I am not convinced with the grounds of transfer petition and therefore, I am not inclined to allow the same. Page No 2 of 4

5. Accordingly, this Transfer Civil Miscellaneous Petition stands dismissed. No costs. Consequently, connected Civil Miscellaneous Petition is closed.
