ORDER

This Writ Petition has been filed by the petitioner seeking for a Writ of Mandamus, to direct the first respondent to consider the petitioner's representation dated 22.07.2025 and pass orders in accordance with law, within the time specified by this Court.

2. Since no adverse order has been passed against the respondents 3 to 5, notice to the respondents 3 to 5 is dispensed with.

3. Mrs.S.Anitha, learned Special Government Pleader, accepts notice on behalf of the 1st respondent and Mr.S.Balaji, learned Government Advocate (Crl.Side), accepts notice on behalf of the 2nd respondent. In view of the consent expressed by the parties, this writ petition is taken up for final disposal at the stage of admission itself. Page No.2 of 6

The case of the petitioner is that there was a dispute between two groups with regard to a temple worship in Vallipuram Village, Namakkal Taluk and the temple is situated in Survey No.52/6 of the said village. Under such circumstances, one M.Raju has filed a writ petition before this Court in W.P.No.28226 of 2022 and this Court, vide order dated 11.11.2022, directed the petitioner therein to approach the civil court for suitable remedy. Thereafter, the respondents 3 to 5 have put up a fence blocking the common pathway that has been in use for generations to access the temple. Therefore, the petitioner has made a representation dated 22.07.2025 before the respondents 1 and 2 requesting them to take action against the respondents 3 to 5, enabling the petitioner and his community people to use the common pathway. Since the same was not considered by the respondent, the petitioner has filed this writ petition before this Court for appropriate orders.

5. Though very many grounds have been raised in this writ petition, learned counsel appearing for the petitioner submits that, this Court may permit the petitioner to approach the competent Civil Court as per the order passed by this Court in W.P.No.28226 of 2022, dated Page No.3 of 6

11.11.2022, for the prayer sought for in this writ petition. Hence, he prays that, this Court may grant the above liberty to the petitioner.

6. In view of the limited request sought for by the learned counsel appearing for the petitioner, this Court, without expressing any opinion on the merits of the case, grants liberty to the petitioner to workout the remedy in the manner known to law.

7. With the above liberty, this Writ Petition is dismissed. No costs.
