Prayer: Petition is filed under Article 226 of the Constitution of India, seeking Writ of Mandamus, directing the respondents 1 to 3 to vacate the 4th respondent from the petitioner's house in Door No.3, VOC Street, Kanagam, Tharamani, Chennai-600 113 by considering the petitioner's representation dated 18.12.2024 in compliance with the provisions of Sections 23(2) of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007.

ORDER
The Writ Petition is filed for the relief of a Mandamus, directing the respondents 1 to 3 to vacate the 4th respondent from the petitioner's house in Door No.3, VOC Street, Kanagam, Tharamani, Chennai-600 113 by considering the petitioner's representation dated 18.12.2024 in compliance with the provisions of Sections 23(2) of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. 2/7
2. With consent of both the parties, this petition is taken up for final hearing.
3. The petitioner purchased the subject property vide sale deed No.872 of 1996. The property tax receipts, water tax receipts, etc., stands in the name of the petitioner. The petitioner would submit that the 4th respondent is none other than his daughter-in-law. His son and the 4th respondent were living happily in the subject property. Thereafter, due to difference of opinion, they got separated. Presently, the petitioner's son is living somewhere else.
4. While so, the 4th respondent along with her parents entered the subject property and started living there. They verbally abused the petitioner and attempted to assault him and his wife. Now the petitioner and his wife are living in a rented house. Therefore, the petitioner lodged a complaint before the SHO, J2, Adayar Police Station. Since there was no action in this regard, the petitioner once again made a complaint before the 3rd respondent on 13.11.2019 and 3/7
CSR.No.336 of 2019 was issued.
5. Since there is no progress, the petitioner submitted a representation dated 18.12.2024 to the respondents to take action against the 4th respondent. The 2nd respondent issued a notice dated 14.05.2025 for hearing on 28.05.2025. However, no enquiry was conduced as contemplated under the Maintenance and Welfare of Parents and Senior Citizens Act. Aggrieved thus, the petitioner is before this Court.
6.Heard the submissions made on either sides and perused the records.
7. Considering the fact that the petitioner has made a representation as early as on 18.12.2024 and since there is no progress, a direction is issued to the 2nd respondent to complete the enquiry and pass orders on the representation of the petitioner dated 18.12.2024, within a period of 8 weeks from the date of receipt of a copy of this 4/7
order.
