This Petition has been filed to condone the delay of 5157 days in filling this petition to set aside the abatement caused due to the death of the 1st appellant S.Rathinasamy in the above S.A.No.1094 of 2007.

2. Heard the learned counsel for the petitioners, and learned counsel for the respondents and perused the material available in the record.

3. On being satisfied with the averments stated in the affidavit filed in support of the petition, this Court is inclined to condone the delay, subject to costs.
