The petitioner herein apprehends arrest at the hands of the respondent police for the offences punishable under Sections 314, 318(4), 296(b) and 351(2) of BNS 2023 in Crime No.519 of 2025, on the file of the respondent 1/4

Police, seeks anticipatory bail.

2. The content of he FIR lodged by the Bank Manager, Union Bank of India, Red Hills Branch indicates that this petitioner has presented the cheque issued by his friend Anandhan for a sum of Rs.31,00,000/- drawn from an account already closed. The cheque been passed by the Union Bank of India inadvertantly. The petitioner herein has utilized the money and when the bank officials asking him to return back the money wrongly credited in his account, he had abused them with language and also threaten them with dire consequences. Hence, the present petition.

3. The learned counsel appearing for the petitioner submitted that because of the attitude of the Banker, his business has ruined. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4. The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and opposed for grant of anticipatory bail to the petitioner.

5. This Court on perusing the complaint as well the exchange of 2/4

notice clearly show that it is a case of connivance between this petitioner and one Anandhan who had presented a cheque for collection drawn from the account which already closed. The matter to be probed, to find out whether any bank officials are also involved in this Crime or not.

6. In such circumstances, this case is not a fit case for granting anticipatory bail. Hence, this Criminal Original Petition stands dismissed. 03.09.2025 Vv To 1.The Judicial Magistrate-II, Ponneri
