ORDER
The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 409, 467, 468, 420 and 471 of IPC in Crime No.94 of 2025, on the file of the respondent Police, seeks anticipatory bail.

The case of the prosecution is that the petitioner is the Deputy Manager of Bank and he has closed some of the fixed deposits prematurely and with connivance of other accused transferred a sum of Rs.4.36 Crores and subsequently, fabricated accounts of bank for the purpose of screening the offence.
3. The learned counsel for the petitioner submits that the petitioner is an innocent person and he is a Deputy Branch Manager in IndusInd Bank of Anna Nagar Branch in Chennai. He further submits that the petitioner has not committed any offence as alleged by the prosecution. He further submits that there is no previous case pending against the petitioner and the petitioner is ready to abide by any conditions that may be imposed by this Court and ready to furnish sufficient solvent sureties for his release. Hence, he prays for grant of anticipatory bail to the petitioner.
4. The learned Government Advocate (Criminal side) for the respondent police, reiterated the prosecution case and submits that the petitioner acted in the capacity of a "Maker" in respect of such entries in the de-facto
complainant's account. He further submits that the co-accused viz., A3, A4, A5 and A7 had already arrested in this case. He further submits that investigation in this case is pending and there is no money transactions between the petitioner's account and the other accused persons. However, he opposed for grant of anticipatory bail to the petitioner.
5. Heard the learned counsels and perused the materials available on record.
6. I have gone through the F.I.R and other connected materials. Even though it is alleged that the petitioner was responsible for the premature closure of three fixed deposits bearing Nos. 300948785008,300948786289 and 300948784582 amounting to Rs.40,14,250/- on 20.03.2023, Rs.38,00,0000/- and on 27.03.2023 and Rs.40,00,000/- on 27.03.2023 respectively. Subsequently the money was also transferred to A4 and A6 accounts. 7.Considering the submissions made by both sides and the facts of the case and the petitioner is not benefited by the monetary transactions, this Court is inclined to grant anticipatory bail to the petitioner, subject to certain conditions.

Accordingly, the petitioner is ordered to be released on anticipatory bail in the event of arrest or on his appearance, within a period of fifteen (15) days from the date of receipt of a copy of this order before the learned Additional CCB Court, Egmore at Chennai on condition that the petitioner
shall execute a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand Only), with two sureties, each for a like sum to the satisfaction of the respondent police or the police officer who intends to arrest or to the satisfaction of the learned Magistrate concerned and on further condition that: (a) the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;
(b) the petitioner shall report before the respondent police, everyday at 10.30 a.m., for a period of four weeks and thereafter as and when required for interrogation; (c) the petitioner shall not tamper with evidence or witness either during investigation or trial;
(d) the petitioner shall not abscond either during investigation or trial;
(e) on breach of any of the aforesaid conditions, the learned Magistrate/ Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji Vs. State of Kerala [(2005) AIR SCW 5560]; and;
(f) if the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S.
