This application has been filed to frame the draft issues submitted by the applicant/defendant as additional issues in the above suit.

2. This Court, considering the averments made in the application, is of the view that except the issue as to whether the suit is barred by limitation, no other issue is required to decide the facts in issue between the parties.

Accordingly, the additional issue is framed as to "Whether the Suit is barred by limitation".

3. Post the matter before the Additional Master No.III for recording evidence on 01.02.2024.
