Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, directing the respondents particularly the 3rd respondent the District Manager/Deputy Collector (Tasmac) Coimbatore (South) District to revoke the suspension order of the petitioner dated 22.04.2025 in Na.Ka.No.310/2025/RV1 of the 3rd respondent and pass appropriate orders and further directions to the 2nd and 3rd respondents to reinstate the petitioner into service as supervisor in the Tasmac Shop No.1667 by considering his representation dated 12.08.2025. O R D E R
This writ petition has been filed seeking quashment of the order of the 3rd respondent, the District Manager / Deputy Collector (Tasmac), Coimbatore (South) District in Na.Ka.No.310/2025/RV1 dated 22.04.2025 and to consequently, direct the 2nd and 3rd respondents to reinstate the petitioner into service as Supervisor in the Tasmac Shop No.1667, by considering his representation dated 12.08.2025.
2. Learned counsel for the petitioner would submit that for no fault on 2/5
the part of the petitioner, he was suspended from service on the ground that there is a MRP violation. It is the contention of the petitioner that on a particular day, the petitioner was not at all present in the Tasmac shop and he went to the Bank to deposit the Tasmac Sales amount. Therefore, the suspension is ipso facto void.
3. Though, the learned counsel for the petitioner raised such an objection, he restricted his prayer and submitted that it would suffice, if the respondents dispose of the proceedings pending against the petitioner within a reasonable time.
4. In view of the aforesaid submission made by the learned counsel for the petitioner, this Court, without going to the merits of the case, directs the 3rd respondent to complete the enquiry in respect of the petitioner's suspension order dated 22.04.2025 and pass final orders on its own merits and in accordance with law, within a period of four (4) weeks from the date of receipt of a copy of this order, after hearing the petitioner. 3/5
5. In the result, this Writ Petition is disposed of with the above observations. Consequently, the connected miscellaneous petitions are closed. No costs.
