PRAYER in W.P.No.33864 of 2025: Writ Petition filed under Article 226 of Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus calling for the records pertaining to the impugned order passed by the 3rd respondent herein, passed in Na.Ka.No.M1/5533/2025, dated 20.06.2025 and quash the same and conforming order passed by the 3rd respondent in Na.Ka.No.628/2006 dated 24.08.2006, House Site No.123 situated at Elrampattu Village in Survey Nos.53/4A, 4B, 6B2 and other Survey Nos. PRAYER in W.P.No.34253 of 2025: Writ Petition filed under Article 226 of Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus calling for the records pertaining to the impugned order passed by the 3rd respondent herein, passed in Na.Ka.No.M1/5533/2025, dated 20.06.
2025 and quash the same and conforming order passed by the 3rd respondent in Na.Ka.No.628/2006 dated 24.08.2006, House Site No.121 situated at Elrampattu Village in Survey Nos.53/4A, 4B, 6B2 and other Survey Nos. For Petitioner(s) : Mr.K.Gangadaran in both WPs For Respondent(s) : Mr.N.Naveen Kumar in both WPs Government Advocate COMMON O RDER These two writ petitions have been filed challenging the order passed by the 3rd respondent dated 20.06.2025 thereby cancelling the free House Site Patta issued to the petitioners herein.
2. Heard the learned counsel on either side and perused the materials 2/6
available on record.
3. Both the petitioners were issued free House Site Patta in respect of Plot Nos.121 and 123 situated at Elrampattu Village, by the 3rd respondent on 24.08.2006 on certain conditions. While being so, based on a complaint lodged by one Kannayiram, enquiry was conducted by the 4th respondent and a report was submitted thereafter. From the enquiry report, it was found that petitioners were residing elsewhere and they have not put up any construction in the allotted plots, till date.
4. It is seen that the aforesaid plots were allotted in favour of the petitioners in the year 2006. That apart, the petitioner in W.P.No.34253 of 2025 was already assigned with a plot, suppressing the said fact, she was allotted with another Plot in Plot No.121 under the free House Site patta scheme. Further, Plot Nos.121 and 123 are obstructing the pathway. Therefore, the 3rd respondent has rightly cancelled the free house site patta issued in favour of the petitioner in W.P.No.34253 of 2025.
5. In view thereof, there is no need to interfere with the order(s) of the 3rd respondent dated 20.06.2025. The writ petitions stand dismissed, however, the 3/6
petitioner in W.P.No.33864 of 2025 is at liberty to file a fresh application seeking assignment of free house site patta. On receipt of any such application, the 4th respondent is directed to verify the status and if the petitioner falls within the zone of consideration of Free House Site Patta, the 4th respondent shall consider the application filed by the petitioner and pass appropriate orders in accordance with law. No costs. Consequently, connected miscellaneous petitions are closed.
