This Criminal Original Petition has been filed by the petitioner/A3, who was arrested and remanded to judicial custody on 08.10.2024, seeking bail in Crime No.416 of 2024 for the alleged offences punishable under Sections 8(c), 20(b)(ii)(A) of Narcotic Drugs and Psychotropic Act, 1985 and Sections 123 & 308(5) of BNS, 2023.

2. The case of the prosecution is that the accused were in illegal possession of 340 grams of Ganja. Hence the case.

3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He also submitted that the petitioner has not committed any offence as alleged by the prosecution, however, he is in custody from 11.10.2024. He further submitted that the similarly placed co-accused has already been enlarged on bail by this Court and the petitioner is also ready to abide by any stringent conditions that may be imposed by this Court. Learned Government Advocate (Criminal Side) appearing for the respondent police submitted that the petitioner/A3 along with two other accused was found to be in illegal possession of 340 grams of Ganja and out of which, 100 grams of Ganja was recovered from this petitioner alone. He further submitted that eight previous cases are pending against the petitioner, however, in respect of the co-accused, there is no previous case. Hence, he opposed for granting bail to the petitioner.

5. Heard both sides and perused the materials available on record.

6. Taking into consideration the facts and the submissions made by the learned Government Advocate (Criminal Side) and also considering the previous cases pending against the petitioner, this Court is not inclined to grant bail to the petitioner.
