PRAYER : Transfer Civil Miscellaneous Petition filed under 24 of Code of Civil Procedure, pleased to withdraw the H.M.O.P.No.73 of 2024 on the file of the Family Court at Cuddalore and transfer the same to the Family Court at Nagapattinam.

ORDER
The petitioner wife has filed the above Transfer Civil Miscellaneous Petition seeking to transfer H.M.O.P.No.73 of 2024 1/4
pending on the file of the Family Court at Cuddalore to the file of the Family Court, Nagapattinam, for the reasons set out herein below:- a.The respondent had caused immense mental and physical torture on the petitioner and had gone to the extent of accusing that the child was not born to him.
b.The respondent has not paid any maintenance either to the petitioner or to the child.
c.The matter is now pending before the Family Court where the presence of the petitioner for every hearing is required and considering the fact that the petitioner is residing at Nagapatinam and not receiving any financial support from the respondent finds it difficult to travel all the way to Cuddalore.
2.Heard the learned counsel for the petitioner and perused the records.
3.Considering the above circumstances, the request for transfer appears justified, therefore, H.M.O.P.No.73 of 2024 now pending on the file of the Family Court at Cuddalore is withdrawn and transferred to the file of the Family Court, Nagapattinam.

4.Accordingly, the Transfer Civil Miscellaneous Petition is allowed. No costs. Consequently, connected miscellaneous petition is closed.
