C.M.P.No.15287 of 2017 is filed to condone the delay of 660 days in filing the above appeal.
C.M.A.SR.No.68343 of 2017 is filed against the judgment and decree dated 07.07.2015 made in M.C.O.P.No.62 of 2014 on the file of the Motor Accidents Claims Tribunal, IV Additional District Judge, Ponneri.
2.Heard the learned counsel appearing for the petitioner and perused the materials available on record.
3.According to the petitioner, the award was passed on 07.07.2015. The petitioner's head office is at Hyderabad and due to prevailing situation in Andhra Pradesh, they were not able to send the records to their counsel in Chennai to file the appeal in time. Hence, there was a delay of 660 days in filing the appeal. The petitioner/Transport Corporation is not diligent enough to prosecute the case. The reason given by the petitioner for condoning the delay of 660 days in filing the appeal is not valid. In view of the same, this
Court is not inclined to condone the delay. Accordingly, C.M.P.No.15287 of 2017 stands dismissed and consequently, C.M.A.SR.No.68343 of 2017 is rejected. No costs. 28.01.2019 rst/kj To Motor Accidents Claims Tribunal, The IV Additional District Judge, Ponneri.
