Section-SS/CM Cell/2025/CO395, dated 15.07.2025, on the file of the respondents and quash the same as illegal, incompetent, without jurisdiction further direct the respondents to release the

results of the petitioner for the subjects in CP26B- Management Accounting, CP26A-Advanced Cost Accounting, and CV26A-Income Tax in the exams conducted during the November 2022.

ORDER

This Writ Petition has been filed challenging the order dated 15.07.2025 passed by the third respondent, thereby rejecting the request made by the petitioner to publish his result for B.Com Degree arrear examination held in November, 2022.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner, after completing his 12th Standard, joined Alpha Arts and Science College, which is affiliated to the first respondent. During his final year B.Com Degree Course, the petitioner appeared for the sixth semester examinations. However, he could not succeed in three subjects. Therefore, he applied to appear for the arrear examinations scheduled in November, 2022 and paid the prescribed examination fee of Rs.530/- by way of Demand Draft

dated 07.11.2022, drawn on Indian Bank, Madras University Branch. However, his results were not published on the ground that the examination fee was due. Therefore, the petitioner approached various authorities, but the same was of no use. Finally, his representation was rejected by the third respondent on the ground of examination fee due.

4. The learned Standing Counsel appearing for the respondents submitted that the relevant records have not been received. Further, though the petitioner had taken a demand draft dated 07.11.2022, the same was submitted before the third respondent only on 14.11.2022, i.e. seven days after the last date prescribed for payment of examination fee. He further submitted that instead of approaching the Grievance Redressal Cell, the petitioner approached the respondents. Therefore, his representation was rejected as not feasible for compliance.

5. Admittedly, the petitioner had taken a demand draft dated 07.11.2022, drawn on Indian Bank, Madras University Branch, for a sum of Rs.530/- towards the examination fee for three arrear papers, viz., CP26BManagement Accounting, CP26A-Advanced Cost Accounting and CV26A-

Income Tax Law and Practice II. Though the demand draft was submitted belatedly, it was duly accepted by the respondents and hall ticket was issued to the petitioner permitting him to appear for the arrear examinations. The demand draft was also encashed by the respondents. However, the respondents failed to publish the petitioner's result. Thereafter, immediately, the petitioner approached several authorities and finally, his request was rejected as not feasible for compliance. It is unfortunate that a poor student, who was permitted to write the examinations after payment of the prescribed fee, which was duly encashed by the respondents, has been deprived of his results, that too on the ground of examination fee due. Once the examination fee was accepted and encashed, and the petitioner was permitted to appear for the examinations, the respondents cannot simply wash their hands of the matter on the ground that the petitioner failed to approach the Grievance Redressal Cell for redressal of his grievance.

6. In view of the foregoing discussion, the order dated 15.07.2025 passed by the third respondent cannot be sustained and is liable to be set aside. Accordingly, the same is hereby set aside. The respondents are directed to publish the petitioner's result for the subjects of Management Accounting,

Advanced Cost Accounting and Income Tax Law and Practice II pertaining to the B.Com Degree arrear examinations held in November 2022, forthwith.
