Criminal Original Petition filed under Section 528 of the BNSS to call for the records pertaining to the impugned charge sheet pending on the file of the District Munsif-cum-Judicial Magistrate, Veppanthattai, Perambalur District in C.C.No.16 of 2024 filed by the first respondent herein and quash the same. ORDER

This petition has been filed to call for the records pertaining to the impugned charge sheet pending on the file of the District Munsif-cum-Judicial Magistrate, Veppanthattai, Perambalur District in C.C.No.16 of 2024 filed by the first respondent herein and quash the same.

2. On a reading of the statements recorded from the witnesses under Section 161(3) Cr.P.C., it is seen that there are specific allegations against the petitioners and also the involvement of the petitioners and there is specific overtact against them and sufficient materials are available to proceed against them further in accordance with law. The grounds taken by the petitioners, are not sufficient to quash the case in C.C.No.16 of 2024 as against the petitioners.

3. Therefore, this petition is dismissed. However, the petitioners are at liberty to take all their defences during the trial before the Court below. 09.12.2024 cs 2 / 4
