Respondents Prayer:- Writ Petition filed under Article 226 of the Constitution of India, 1950, praying to issue a Writ of Mandamus, directing the Second Respondent herein to consider and dispose of Petitioner's representation dated 18.03.2017 submitted through Third Respondent, wherein the Petitioner has claimed retrospective regularization of his service so as to enable the Petitioner to claim pension and other monetary benefits within a time frame.

When it is pointed out that the Petitioner has an effective alternative remedy to raise an industrial dispute through a Trade Union under Section 2(k) of the Industrial Disputes Act, 1947, before the jurisdictional Labour Court, Learned Counsel for the Petitioner seeks permission of the Court to withdraw this Writ Petition with liberty to resort to the aforesaid procedure and he has also made an endorsement to that effect in the court record. It is made clear that for the purpose of reckoning limitation for availing the aforesaid remedy, the period from the date of filing of the Writ Petition, viz., 19.06.2017, till the date on which the certified copy of this order is made ready by the Registry, shall be excluded. 3.

In fine, the Writ Petition is dismissed as withdrawn granting such liberty. No costs.
