This Criminal Original Petition has been filed to direct the learned District Munsif-cum Judicial Magistrate, Nannilam to dispose of the case in 1/4

C.C.No.123 of 2013 as expeditiously as possible.

2. The learned counsel for the petitioners submitted that the defacto complainant filed a private complaint against the petitioners in C.C.No.123 of 2013 before the learned District Munsif-Cum Judicial Magistrate, Nannilam on 24.09.2013 for the offence under Sections 294(b), 352, 506(ii) of IPC. After the receipt of summons, the petitioners have entered appearance. During the pendency of the case, A2 died on 21.05.2016. The case is pending at the stage of respondent/complainant side evidence for the past 5 years without any progress. Hence, the present petition has been filed.

3. Heard the learned counsel for the petitioner.

4. On perusal of Court diary, it is seen that the C.C.No.123 of 2013 is not yet disposed and the case stands posted for copies, evidence, questioning, evidence, for further proceedings respectively. The case is pending from 19.10.2013 without any valid reason. Therefore, this Court directs the District Munsif-cum Judicial Magistrate, Nannilam to dispose of the C.C.No.123 of 2013 as expeditiously as possible, preferably, within a period of four months 2/4

from the date of receipt of copy of this order.

5. With the above direction, this Criminal Original Petition stands disposed of.
