ORDER

This Criminal Original Petition has been filed to direct the learned District Munsif-cum Judicial Magistrate, Nannilam to dispose of the case in C.C.No.1 of 2017 as expeditiously as possible.

2. The learned counsel for the petitioners submitted that the defacto complainant filed a private complaint against the petitioners in C.C.No.1 of 2017 before the learned District Munsif-Cum Judicial Magistrate, Nannilam on 03.01.2017 for the offence under Section 435 of IPC. After the receipt of summons, the petitioners have entered appearance. The case is pending at the stage of respondent/complainant side evidence for the past 5 years without any progress. Hence, the present petition has been filed.

3. Heard the learned counsel for the petitioner.

4. On perusal of Court diary, it is seen that the C.C.No.1 of 2017 is not yet disposed and the case stands posted for evidence, copies, framing of 2/4

charges, service pending, questioning, for further proceedings. The case is pending from 05.01.2017 without any valid reason. Therefore, this Court directs the District Munsif-cum Judicial Magistrate, Nannilam to dispose of the C.C.No.1 of 2017 as expeditiously as possible, preferably, within a period of four months from the date of receipt of copy of this order.

5. With the above direction, this Criminal Original Petition stands disposed of.
