ORDER
The petitioner herein seeks a direction to the second respondent to dispose of the petitioner's representation dated 19.12.2023 by conducting enquiry on merits within a time frame fixed by this Court. 2/6
2. It is the case of the petitioner that his grand father Varadhapillai died on 14.06.2006 leaving behind the petitioner's father Veerasamy and the children born through his second wife Chellammal. The private respondents namely Chellammal and her children obtained legal heirs certificate in their favour without including the name of the petitioner's father Veerasamy. Therefore, the petitioner submitted a representation on 19.12.2023 seeking cancellation of the legal heirs certificate issued in favour of the private respondents without including the name of the petitioner's father Veerasamy and the said representation has not been considered. Hence, the petitioner is before this Court.
3. Mr.V.Ramesh, learned Government Advocate, who takes notice for the respondents 1 to 4, would submit that the representation submitted by the petitioner will be enquired into and final order will be passed on its own merits, within a time frame fixed by this Court. 3/6
4. In view of the same, without going into the merits of the claim made by the petitioner, the second respondent is directed to consider the representation of the petitioner dated 19.12.2023 and pass final order, on its own merits, within a period of 12 weeks from the date of receipt of copy of this order, after affording reasonable opportunity to the petitioner, private respondents 5 to 9 and other legal heirs if any.
5. With the above directions, this Writ Petition is disposed of. No costs.
