Respondents Prayer :- Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondent to reconvey the punja land comprised in S.No.47/1A2 measuring 2.11 acres and S.No.33/1 measuring 3.15 acres and S.No.34/2 measuring 0.47 acres and another extent of 0.40.5 hectares out of 1.16.0 hectares in S.No.36 in Venkalapuram Village, Tirpathur Taluk, Vellore District and pay appropriate compensation to the petitioner in accordance to law. ORDER
This writ petition is filed seeking reconveyance of the lands which were already acquired, comprised in S.No.47/1A2 measuring 2.11 acres and S.No.33/1 measuring 3.15 acres and S.No.34/2 measuring 0.47 acres and another extent of 0.40.5 hectares out of 1.16.0 hectares in S.No.36 in Venkalapuram Village, Tirpathur Taluk, Vellore District.

The said lands were already acquired by the Government of Tamilnadu on behalf of the Tamilnadu Electricity Board for additional office building at Venkalapuram Village in survey Nos.33/1, 34/2, and 47/1A to an extent of 0.78.5 hectares, and to an extent of one acre in survey No.36 of Venkalapuram Village was acquired for the purpose of burial ground for Adidravidar people in Venkalapuram village. After acquisition, the subject lands were acquired under Harijan Welfare Act, 31 of 1978. Though the petitioners objected the acquisition, it was considered and award has been passed in award No.4 of 1988 dated 05.06.1987. The compensation amount was also paid to the land owners. Therefore, the possession of the said property had been taken over.
3.Further, the property comprised in survey No.36 to an extent of one acre was taken over on 27.03.2000 situated at Venkalapuram Village for the purpose of Adidravidar Welfare Department from the land owners. Therefore, the entire land has been now utilised for which the land was acquired by the respondents. Therefore, the request of the petitioners for reconveyance of the said land does not arise and the writ petition is devoid of merits.
4. Accordingly, this writ petition is dismissed. No order as to costs.
