ORDER

This Criminal Original Petition has been filed to direct the respondent to register the case against the accused persons on the basis of the complaint given by the petitioner dated 21.06.2021 and consequently to direct the respondent to supervise the investigation.

The learned counsel for the petitioner submitted that one Kumaran misusing the name of the petitioner claimed a loan of Rs. 5 lakhs from ICICI and cheated the petitioner and also he took the shop premises of the petitioner on lease and failed to pay the rent of Rs. 1,80,000/-. Thereafter, the petitioner lodged a complaint before the respondent police. However, no steps was taken by the respondent police for registering the complaint, resulting in filing the petition.

3. The learned Government Advocate (Crl. Side) submitted that one Kumaran had filed a civil suit against the petitioner in O.S.No.6512 of 2022 on the file of the Additional City Civil Court,Allikulam for recovery of money and it is pending. He further submitted that on receipt of the complaint enquiry was conducted and the same has been closed on basis of the written undertaking that she would seek the remedy before the civil Court. Therefore, petition enquiry was closed.

4. Recording the submission made by the learned Government Advocate (Crl. Side), this Court is of the view that no further order is necessary in this regard.
