This application is filed for permission to make payments towards electricity bill in respect of the Office of the Official Liquidator from and out of the common pool fund subject to the condition that it would be reimbursed to the common pool fund from the funds received from the Pay and Accounts Office, Ministry of Corporate Affairs, Chennai.

2. I heard the learned Deputy Official Liquidator.

The learned Deputy Official Liquidator submitted that the TANGEDCO issues bills on a monthly basis and that the stipulated procedure for obtaining necessary payment involves sending the bills to the Pay and Accounts Office, Ministry of Corporate Affairs along with the sanction of the Official Liquidator and to await payment from the Pay and Accounts Office thereafter. He further submitted that this process takes considerable time and that, therefore, the Official Liquidator is constrained to pay the bill belatedly along with surcharge. Therefore, the present application has been taken up for the relief set out supra. The Official Liquidator has also filed a report dated 15.11.2019 in support of this application.

4. On consideration of the submissions of the learned Deputy Official Liquidator and upon examining the aforesaid report dated 15.11.2019, it is just and necessary to allow this application. Accordingly, the following directions are issued:

(i) The Official Liquidator is permitted to issue cheques towards payment of the electricity bill in respect of the premises at No.29, Rajaji Salai, Corporate Bhavan, 2nd Floor, Chennai, from and out of the common pool fund.

(ii) Upon receipt of the amount due in respect of such electricity bill from the Pay and Accounts Office, Ministry of Corporate Affairs Chennai, the Official Liquidator is permitted to reimburse the said amount to the common pool fund.

(iii) The Official Liquidator is also permitted to book the incidental expenses relating to the present application from and out of the common pool fund.
