JUDGMENT

(Judgment of the Court was delivered by D.KRISHNA KUMAR, J.) Assailing the order passed by the learned Single Judge in W.P.No.31653 of 2024 dated 25.10.2024, the SRM University has filed the present writ appeal.

2. The respondent herein has filed the above writ petition to i)quash the order passed by the appellants University dated 18.10.2024, debarring the respondent from appearing for the University Examination, Oct/Nov 2024 due to lack of attendance; and directed him to redo the programme for the same semester in the next academic year 2024-2025 ii) and consequently direct the appellants herein to allow him to attend the university examination for the second year BCA Course starts from 21.10.2024 onwards.

3. Learned Single has disposed of the writ petition by observing that since the writ petitioner was suffering from medical conditions, he was unable to attend the classes and consequently direct the appellant herein to allow the writ petitioner for one time to participate in the next Page 2/5

semester examination. Aggrieved over the above said order, the University has filed the instant writ appeal.

4. Today, learned counsel appearing on either side have argued the matter elaborately, supporting their respective contentions.

5. After elaborate discussion, learned counsel for the appellant made a request before this court that the respondent will satisfy, if the appellant University considers the application of the respondent for issuing Transfer Certificate, without insisting to pay next semester fees, so that he can join in some other College in the next semester.

6. Replying to the above, learned counsel for the appellant submitted that, if the respondent made any application requesting to issue Transfer Certificate, it will be considered immediately by the University and Transfer certificate will be issued, without insisting for payment of next semester fees.

7. Recording the submission made by the learned counsel for the appellants as well as the respondent, this writ appeal is disposed of accordingly. There shall be no order as to costs. Consequently, CMP No.24493 of 2024 is closed.
