O R D E R

This writ petition has been filed challenging the order passed by the first respondent dated 06.08.2025 thereby rejecting the representation submitted by the petitioner seeking cancellation of patta issued in favour of respondents 4 and 5 herein in respect of the property comprised in survey No.86/2 of Merattur Village, Ponneri Taluk, Tiruvallur District.

The property comprised in survey No.86/2 of Merattur Village, Ponneri, Tiruvallur District admeasuring 0.49.5 hectares was originally a part of a larger estate and belonged to one Chinnaswamy and Nagammal. By the sale deed dated 03.04.1970, a piece of land was purchased by one, Swaminathan and he was issued patta No.107. 2/6

Thereafter, it was purchased by the petitioner by the sale deed dated 27.05.1998. In the meantime, in the year 1978 itself, the Government the Land Title Improvement and Registration Project Scheme and the subject land was changed into a Group Patta No.196 in favour of the predecessors-in-interest of the respondents 4 & 5 herein. After purchase, the petitioner applied for patta and mutation of revenue records. 3.

However, on perusal of records, it is revealed that there is title dispute in respect of the subject property between the petitioner and respondents 4 & 5. The object of the Tamil Nadu Patta Passbook Act, 1983 is to issue patta to the holders of the land. It indicates that the persons holding title and possession are entitled to secure patta by filing an appropriate application under the said Act. In the event of any dispute regarding title, ownership, boundaries or possession, etc., the revenue authorities have to relegate the parties to approach the competent civil court for appropriate relief. Therefore, adjudication of civil disputes either by the revenue authorities or under the writ proceedings are impermissible and the competent civil court alone is empowered to declare title.

Therefore, the request made by the petitioner was rightly rejected and this Court no infirmity or illegality in the impugned order. However, the petitioner is at liberty to approach the civil court for appropriate relief in accordance with law.

With the above liberty, this writ petition is dismissed. Consequently, connected miscellaneous petition is closed. There shall be no order as to costs.
