ORDER
This Writ Petition has been filed seeking a direction to the respondents to sanction one notional increment which falls on 01.04.2018
and pay the difference in terminal benefits such as Gratuity, Leave Salary and revised pension and pension arrears with 10% interest to the petitioner.
2. Mr.A.Vinothraj, learned Standing Counsel takes notice for the Respondents.
3. By consent, this Writ Petition is taken up for final disposal today at the admission stage itself.
4. The case of the petitioner is that the petitioner who joined as a Junior Tradesman in the respondent Corporation in the year 1986 and after rendering 30 years of continuous service, retired from service in the post of Assistant Engineer on 31.03.2019 upon attaining the age of superannuation. The grievance of the petitioner is that he has not been sanctioned with the annual increment which fell due on 01.04.2019 on the ground that his retirement falls one day prior to the said date. He relied on the Government Order in G.O.Ms.No.140, Finance (Pay Cell) Department, dated 25.04.2018 and claims annual increment as well as revision of his terminal benefits with 10% interest. In this regard, he made a representation on 07.05.2025 to the respondents and the same has not been
considered till date. Hence, this Writ Petition.
5. The learned standing counsel appearing for the Respondents would submit that the representation of the petitioner dated 07.05.2025 would be considered on merits within the time frame to be fixed by this Court.
6. Considering the same, without going into the merits of the case, this Court directs the respondents to consider the representation of the petitioner dated 07.05.2025 and pass appropriate orders in the light of G.O.Ms.No.140, Finance (Pay Cell) Department, dated 25.04.2018 and on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.
7. With the above direction, this Writ Petition stands disposed of. No costs.
