ORDER

The petitioner, who was arrested and remanded to judicial custody on 31.05.2025 for the alleged offence under Section 331(4) and 305 of BNS in Crime No.318 of 2025 on the file of the respondent police, seeks bail.

The case of prosecution is that on 31.05.2025 at 11.40 a.m., when the defacto complainant on return back from Chennai after staying in their daughter's home, they saw the front door was broken, all other inner doors and almirah were opened and also a sum of Rs.21,15,000/- kept in first floor bedroom, gold jewels weighing 95 sovereigns and silver lamp weighing 400 grams were found missing. Hence, the complaint was registered against the petitioner.

The learned counsel appearing for petitioner submitted that this is the second petition seeking for bail and there is no specific overtact attributed against the petitioner and he is no way connected with the offence. He would submit that he has not at all committed any of offence as alleged by the 2/5

respondent police and he has been falsely implicated in this case and he will abide by any condition that may be imposed by this court. He would further submit that the investigation is almost completed and that the petitioner has been suffering incarceration from 31.05.2025 for more than three months. Hence, he prayed to grant bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for respondent would submit that there are 2 accused involved in this case and the petitioner is arrayed as A2 and he is having 21 previous cases. He would submit that A1 and A2 have opened the door of house and committed theft of more than Rs.21 lakhs. He would also submit that he belong to State of Andhra Pradesh and now charge sheet was filed and the case is posted for examination of L.W.4 to 10. He would also submit that if he is released on bail, he would hamper the investigation and tamper the witnesses and the investigation almost completed and property was recovered from him. However, he would vehemently opposed to grant bail to the petitioner.

Considering the facts and circumstances and and on seeing the gravity of offence committed by the petitioner, he has broken open the door of the house and committed theft of around Rs.21 lakhs and the fact that there are 21 previous cases pending against him and he is native of State of Andhra Pradesh and so, at this stage, if he is released on bail, there is possibility of tampering 3/5

evidence and hampering investigation and the fact that now the case is posted for examination of L.W.4 to 10 and also the fact that there is no change of circumstances, this Court is not inclined to grant bail to the petitioner.
