O R D E R
The prayer sought for herein is for a Writ of Mandamus directing the respondents to consider and dispose of the petitioner's representation dated 02.11.2022 within a stipulated time fixed by this Hon'ble Court consequently to direct the 3rd respondent Tahsildar Sholinganallur Taluk, Chennai District to issue the Joint Patta to the petitioner's house site property in S.No.164/66 measuring about to an extent of 2 Ares situated at Injambakkam, Sholinganallur Taluk, Chennai District 600 115 and grant such other further relief or reliefs as deem fit and proper to this Court under the circumstances of the case.
2. In respect of the house property in S.No.164/66 measuring about to an extent of 2 Ares situated at Injambakkam, Sholinganallur Taluk, Chennai District 600 115 it is the claim of the petitioner that the property belongs to the grandfather of the petitioner one A.Govindan. The said Govindan died in 1990 and his wife ie., the grandmother of the petitioner also died in 2004. The said Govindan has got two legal heirs ie., two sons viz., G.Pakkiri and G.Arumugam. The said G.Pakkari is none other than the father of the petitioner. 2 / 4
3. Therefore, after the demise of the petitioner's grand parents, the property necessarily had been inherited by the sons viz., G.Pakkiri and G.Arumugam. Therefore, patta has to be issued in the name of the said G.Pakkiri and G.Arumugam and accordingly an application has been given to the Tahsildar by the petitioner on behalf of the said Pakkiri and Arumugam and in order to consider the same the present writ petition has been filed.
4. Heard Mr.R.Anandha Babu, learned counsel for the petitioner and Mrs.N.Senthilselvi learned Government Advocate appearing for the respondents.
5. Learned Government Advocate would submit that the said representation submitted by the petitioner dated 02.11.2022 would be considered by the 3rd respondent, on merits and in accordance with law within a time frame that may be stipulated by this Court.
6. In that view of the matter, this Court is inclined to dispose of this writ petition with the following order.
"That there shall be a direction to the 3rd respondent / Tahsildar to consider the representation submitted by the petitioner on 02.11.2022 on merits and in accordance with law and pass orders within a period of eight weeks from the date of receipt of a copy of this order."
